Terms and conditions - Fractional Experts platform

1. Acceptance of Terms and Conditions

By submitting your information through our Google Form to access our website ("Platform"), you acknowledge and agree to be bound by these Terms and Conditions ("Terms"). If you do not accept these Terms, please do not submit your information.

2. Platform Description

Our Platform is designed to facilitate connections between clients or businesses seeking to fill critical roles or require assistance with budgeted projects ("Clients") and a network of independent professionals/experts ("Experts"). Clients can detail their requirements through a Google Form, and Experts can respond to these requirements with their services.

3. Data Submission and Hiring Scope

To utilize our Platform, Clients must submit accurate and complete information through the Google Form. The project scope and services offered by Experts will be determined based on this information. Any work falling outside the scope provided in the Google Form will be considered a separate project and must be submitted separately on our Platform.

4. Expert Matching

Our Platform aims to match Clients with suitable Experts based on the project details provided in the Google Form. This matching process is automated and relies on the submitted information's accuracy. While we strive to facilitate appropriate matches, we cannot guarantee a perfect match or the availability of Experts at all times.

5. Agreement between Client and Expert

When an Expert expresses interest in your submission, whether for project assistance or a full-time role, you may enter into a contractual relationship with them within the defined scope outlined in your submission. Our Platform serves solely as a facilitator for these connections and is not a party to any agreement that may be formed between you and the Expert.

6. Payments

Payments for services rendered by Experts will be based on the final payment agreed between the Expert and Client.
Payments for services rendered by Experts will be processed through the Platform's payment system.
Clients will be charged the agreed-upon fees i.e. the clients submitted budgeted amount, which include the Expert's service fees and any applicable platform service fees.
Our service specializes in connecting you with top-tier experts, tailored to your project's scope and budget. We charge a straightforward fee of 15% of the annual salary or project value, ensuring transparency and simplicity in our pricing.
In addition to this, we offer a 30-day replacement cycle for your assurance. If the initially assigned expert does not meet your satisfaction within the first 30 days, we provide a suitable replacement at no extra fee.
For payment arrangements, we take a secure approach. 100% of the payments are held by our company and are released to your expert(s) in pre-agreed milestones throughout the project. This process is in place until project completion or the end of the 30-day replacement cycle, guaranteeing efficient management of your investment.

7. Disputes and Resolution

In case of disputes between you and Experts related to the defined project scope, we encourage both parties to resolve the issue amicably.
Our Platform is not responsible for mediating or resolving disputes related to additional scope beyond the information provided in the Google Form.

8. User Responsibilities

You agree not to submit false, harmful, offensive, or illegal information through the Google Form.
You must comply with all applicable laws and regulations.

9. Intellectual Property

Any project-related content you provide through the Google Form remains your property.

10. Privacy

a. Our Privacy Policy outlines how we collect, use, and protect user information submitted through the Google Form.

11. Modifications and Termination

a. We reserve the right to modify or terminate the Platform at any time without notice.

12. Limitation of Liability

a. We are not liable for any damages or losses resulting from the use of the Platform or services provided by Fractional Experts.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Manitoba, Canada and Nigeria, without regard to their conflict of law principles.
Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Manitoba, Canada and Nigeria.
By submitting your information through the Google Form, you agree to these Terms and Conditions. If you do not agree with any of these terms, please do not submit your information.

Information We Collect – You directly provide us with most of the information we collect: when you register with us, use it, complete forms, or register to any of our programs. We also collect information about your communications with Crosshired as well as any of your posts on our blogs or forums and your communication with other users of Crosshired. In addition, we automatically collect information while you access, browse, view or otherwise use the Site and receive information from third party vendors or other available sources.

Our Legal Basis for Using Your Personal Information - Where relevant under applicable laws, all processing of your personal information will be justified by a "lawful ground" for processing as detailed below.

How Do We Use the Information Collected? – We use personal information to provide you with quality service and security, to operate the Site, understand how people use the Site, and to perform our obligations to you; to ensure platform integrity and security; to prevent fraud; to contact you and send you direct marketing communications; to promote and advertise the Site, our services and the Crosshired platform; to comply with lawful requests by public authorities and to comply with applicable laws and regulations.

How Long Do We Keep Personal Information – We will keep personal information only for as long as is required to fulfil the purpose for which it was collected. However, in some cases we will retain personal information for longer periods of time.

Children - This Site is offered and available to users who are at least 18 years of age and of legal age to form a binding contract. Minors under 18 and at least 13 years of age, are only permitted to use the Site through an account owned by a parent or legal guardian with their appropriate permission. Minors under 13 are not permitted to use the Site or the Crosshired services. We do not knowingly collect personal information from children under 13.

Sharing Personal Information with Third Parties – We share personal information with third parties in order to operate the Site, provide our services to you, fulfil obligations imposed on us by applicable laws and regulations, and prevent fraud, infringements and illegal activities.

Where We Store Personal Information - Some of the personal information you provide to us will be stored or processed on our behalf by third party suppliers and data processors and may be located in other jurisdictions, such as the United States and Israel.

Rights of EU, EEA and UK Users – Where we process personal data related to EU, EEA and UK user, further terms apply to our processing in relation to your rights as a data subject under EU data protection laws.

Specific Provisions for California Residents- If you are a California resident, you are entitled to specific privacy rights.

Updating Personal Information – We take steps to ensure that the personal information we collect is accurate and up to date, and we provide you with the opportunity to update your information through your account profile settings. In the event that you believe your information is in any way incorrect or inaccurate, please let us know immediately.
